Welcome to JC Property Maintenance. These Terms of Service ("Terms") govern your use of our property maintenance services and website. By engaging our services or using our website at jcpropertymaintenance.net, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1Acceptance of Terms
By requesting a quote, scheduling services, or otherwise engaging JC Property Maintenance ("Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and JC Property Maintenance. Your continued use of our services following any modifications to these Terms constitutes acceptance of those changes.
2Description of Services
JC Property Maintenance provides comprehensive property maintenance services throughout Utah, including but not limited to:
- Snow Removal
- Seal Coating
- Crack Sealing
- Line Striping
- Door Repair
- Building Repairs
- Landscaping
- Unit Repairs
The specific scope, nature, and details of services will be outlined in individual service agreements, quotes, or work orders provided to you prior to commencement of work.
3Service Agreements and Quotes
3.1 Quotes and Estimates: All quotes and estimates provided by JC Property Maintenance are valid for thirty (30) days from the date of issue unless otherwise specified in writing. Quotes are based on the information provided by the Client and a visual assessment of the property.
3.2 Scope Changes: If additional work is discovered or requested beyond the original scope, we will provide a revised estimate before proceeding. Additional charges may apply for work outside the original agreement.
3.3 Written Agreements: For ongoing or seasonal services (such as snow removal contracts), a written service agreement may be required. Such agreements will specify duration, pricing, service triggers, and other relevant terms.
3.4 Property Access: The Client agrees to provide adequate access to the property and work areas. The Client is responsible for ensuring a safe work environment and notifying us of any known hazards.
4Payment Terms
4.1 Payment Due: Unless otherwise agreed in writing, payment is due upon completion of services. For larger projects or ongoing contracts, a payment schedule may be established.
4.2 Accepted Payment Methods: We accept cash, checks, and major credit cards. Payment details will be provided upon invoice.
4.3 Deposits: For certain projects, a deposit of up to 50% may be required before work begins. Deposits are non-refundable once work has commenced.
4.4 Late Payments: Invoices not paid within thirty (30) days of the due date may be subject to a late fee of 1.5% per month (18% annually). We reserve the right to suspend services for accounts with outstanding balances.
4.5 Collections: In the event of non-payment, we reserve the right to pursue collection through appropriate legal means. The Client agrees to pay all collection costs, including reasonable attorney fees.
5Cancellation and Rescheduling
5.1 Client Cancellation: Clients may cancel or reschedule services with at least 24 hours' notice without penalty. Cancellations with less than 24 hours' notice may be subject to a cancellation fee of up to 50% of the quoted service price.
5.2 Weather-Related Changes: Services dependent on weather conditions (such as seal coating, line striping, or landscaping) may be rescheduled by either party due to inclement weather without penalty.
5.3 Company Cancellation: We reserve the right to cancel or reschedule services due to weather, equipment issues, safety concerns, or other circumstances beyond our control. In such cases, we will provide as much notice as possible and work with you to reschedule at a mutually convenient time.
5.4 Seasonal Contracts: Early termination of seasonal contracts (such as snow removal agreements) may result in forfeiture of any prepaid amounts or prorated billing based on services rendered.
6Limitation of Liability
6.1 Service Warranty: JC Property Maintenance warrants that all services will be performed in a professional and workmanlike manner consistent with industry standards. If you are not satisfied with our work, please notify us within seven (7) days, and we will work to address your concerns.
6.2 Limitation of Damages: To the maximum extent permitted by law, JC Property Maintenance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, regardless of the cause of action.
6.3 Maximum Liability: Our total liability for any claim arising from services provided shall not exceed the amount paid by the Client for the specific service giving rise to the claim.
6.4 Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, labor disputes, government actions, or supply chain disruptions.
6.5 Snow Removal Disclaimer: While we strive to provide timely and thorough snow removal services, we cannot guarantee complete elimination of all ice or snow at all times. Property owners remain responsible for ongoing safety conditions between service visits.
7Insurance Information
JC Property Maintenance maintains comprehensive insurance coverage including:
- General Liability Insurance
- Workers' Compensation Insurance
- Commercial Auto Insurance
Certificates of insurance are available upon request. Our insurance coverage is designed to protect both our company and our clients from unforeseen incidents during the course of our work.
Client Insurance: Clients are encouraged to maintain their own property and liability insurance. JC Property Maintenance is not responsible for damage to property resulting from pre-existing conditions, normal wear and tear, or circumstances beyond our control.
8Indemnification
The Client agrees to indemnify, defend, and hold harmless JC Property Maintenance, its owners, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
- The Client's breach of these Terms
- The Client's negligence or willful misconduct
- Pre-existing property conditions not disclosed to us
- Third-party claims related to the Client's property
9Dispute Resolution
9.1 Informal Resolution: In the event of any dispute arising from these Terms or our services, both parties agree to first attempt to resolve the matter through good-faith negotiation. Please contact us directly to discuss any concerns.
9.2 Mediation: If informal resolution is unsuccessful, the parties agree to submit the dispute to mediation before a mutually agreed-upon mediator in Salt Lake County, Utah, before pursuing any other remedies.
9.3 Arbitration: If mediation is unsuccessful, any remaining disputes shall be resolved through binding arbitration in Salt Lake County, Utah, in accordance with the rules of the American Arbitration Association.
9.4 Small Claims Exception: Either party may pursue claims in small claims court as an alternative to arbitration, provided the matter qualifies for small claims jurisdiction.
10Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms shall be conducted in the state or federal courts located in Salt Lake County, Utah, and both parties consent to the exclusive jurisdiction of such courts.
11Changes to Terms
JC Property Maintenance reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. We encourage you to review these Terms periodically. Continued use of our services after any modifications constitutes acceptance of the updated Terms.
For ongoing service agreements, we will provide written notice of any material changes that affect your existing contract terms.
12Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13Entire Agreement
These Terms of Service, together with any service agreements, quotes, or work orders provided to you, constitute the entire agreement between you and JC Property Maintenance regarding the subject matter herein and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
